Impeachment of a governor of a state is a constitutional process that carries some level of political undertones that go beyond some considerations especially when political interest is involved at the expense of the public interest.

Governor Siminalayi Fubara of Rivers State finds himself at the center of an impeachment threat that has been lingering since October 2023, with 27 lawmakers reportedly ready to push the process forward.However, the real challenge lies not in securing the required legislative votes but in the next step of the process; the role of the Chief Judge, Justice Simeon Amadi is unarguably important.

The Rivers State Chief Judge plays an important role in determining whether this impeachment attempt will progress or hit a dead end. According to the Nigerian Constitution, once the House of Assembly votes in favor of impeachment, the Chief Judge must set up a seven-man panel to investigate the alleged offenses. But here is the twist: Justice Amadi is widely regarded as a principled and full-time respecter of the law. His reputation as a “decent gentleman” makes it difficult for political forces to compromise his integrity.

The Chief Judge is expected to act solely based on legal merit. The same can’t be said for lawmakers, who are often influenced by party interests and political pressure. If the impeachment charges lack reasonable evidence or appear politically motivated, Justice Amadi may decline to set up the panel, by extension, halting the process. This scenario has happened in past political battles in Nigeria, where judiciary officials have refused to be used as pawns in politically motivated cases.

Further, Governor Fubara has enjoyed and still enjoys significant public sympathy, especially among those who see his impeachment as a political witch-hunt rather than a legitimate constitutional process. Public opinion and political alliances can mount pressure on the judiciary, making it difficult for the Chief Judge to act against the interests of justice and democratic stability. If Justice Amadi chooses legal credibility over political convenience, the impeachment may not go as smoothly as the initiators had planned.

Rivers State will be watching closely in the coming weeks to see how this political drama unfolds. Will the judiciary remain independent, or will political games override due process?
